Prize Draw
Terms

How Housing Perks prize draws work, who can enter, how winners are selected and the terms that apply.

01 — Prize draw terms

Promoter

No purchase or payment is necessary. This is a free prize draw, not a raffle or lottery.

  1. 1.1

    The promoter is Rainly Ltd trading as Housing Perks, company number 14525292, whose registered office is at 320 Firecrest Court, Centre Park, Warrington, England, WA1 1RG (the “Promoter”).

  2. 1.2

    The prize draw is administered through the Housing Perks platform. A participating social landlord, housing association, local authority or other housing provider (a “Housing Provider”) may award points or help communicate the draw, but is not the promoter unless the Draw Details expressly say otherwise.

  3. 1.3

    Questions or complaints about the draw should be sent to hello@yourhousingperks.com or 320 Firecrest Court, Centre Park, Warrington, England, WA1 1RG.

The draw and the Draw Details

  1. 2.1

    These terms apply to each Housing Perks prize draw that refers to them (a “Draw”).

  2. 2.2

    The page or notice for the relevant Draw (the “Draw Details”) will state:

    (a) the opening date and time;

    (b) the closing date and time;

    (c) the number and nature of the prizes, including any material restrictions;

    (d) any maximum number of entries per person;

    (e) when the winner is expected to be selected and notified; and

    (f) any Draw-specific eligibility requirements.

  3. 2.3

    Times in the Draw Details are UK time. Entries received before the opening time or after the closing time will not be accepted.

  4. 2.4

    The Promoter will not change a closing date unless circumstances outside its reasonable control make this unavoidable and the change is fair to people who entered under the original terms. Any permitted change will be communicated through the Housing Perks platform and, where appropriate, by the same channels used to advertise the Draw.

Eligibility

  1. 3.1

    Unless the Draw Details state a narrower eligible group, the Draw is open to registered Housing Perks users who:

    (a) are aged 18 or over;

    (b) live in England, Scotland or Wales;

    (c) have an active and genuine Housing Perks account linked to a participating Housing Provider when they enter; and

    (d) satisfy any additional eligibility requirements in the Draw Details.

  2. 3.2

    Employees, officers and directors of the Promoter, anyone directly involved in administering the Draw, and members of their immediate families or households may not enter. Employees of a Housing Provider may enter only if the Draw Details expressly allow this and they are otherwise eligible as a Housing Perks user.

  3. 3.3

    The Promoter may ask for reasonable evidence of identity, age, residence, Housing Perks account status and eligibility before awarding a prize. A prize may be withheld only where the selected entrant does not meet clearly stated eligibility or entry requirements, has acted fraudulently, or where awarding it would be unlawful.

Free entry and Housing Perks points

  1. 4.1

    Entry is free. No purchase, payment, donation or premium-rate communication is required to enter or win.

  2. 4.2

    Housing Perks points used for a Draw may be awarded:

    (a) free of charge for completing an eligible mission made available through Housing Perks;

    (b) free of charge directly by the Promoter, Housing Perks or a Housing Provider; or

    (c) as an incidental promotional benefit when a user purchases a good or service, including a gift card, at its genuine normal price, provided that the conditions in clause 4.3 are satisfied. A purchase must not be required to enter or win.

  3. 4.3

    Points cannot be bought directly, and no payment may buy an entry. Where points are awarded in connection with a purchase under clause 4.2(c):

    (a) the good or service must be sold at its genuine normal price;

    (b) the price must not be increased, and the quality, quantity, composition or value must not be reduced, before, during or after the relevant promotion in order to reflect the points or the opportunity to participate in a Draw;

    (c) no separate fee, donation, premium-rate communication or other additional payment may be required for the points or the opportunity to participate;

    (d) the purchaser must receive the full ordinary value of the good or service, including the full stated face value of a gift card, and the points must be an incidental promotional benefit; and

    (e) purchase-linked points and entries must receive no preferential treatment. Any no-purchase route required by law must be clearly promoted, no less convenient than the purchase-linked route and treated equally in the allocation of prizes.

  4. 4.4

    Points are awarded only after Housing Perks records a completed and verified eligible mission, qualifying purchase or direct discretionary award by the Promoter, Housing Perks or a Housing Provider. A user is not entitled to points merely because they ask or submit a request for them. Rent, service charges, tenancy payments, donations, premium-rate communications and payments that are not for a qualifying good or service under clauses 4.2(c) and 4.3 cannot generate points that may be used in a Draw.

  5. 4.5

    Points have no cash value, are personal to the user and cannot be sold, transferred, exchanged for money or combined with another user’s points.

05 — Prize draw terms

How to enter

  1. 5.1

    During the entry period, an eligible user may select the Draw in Housing Perks and exchange available points for entries by following the on-screen instructions.

  2. 5.2

    One point exchanged equals one entry in that Draw. Each valid entry has an equal chance of being selected. Therefore, a user with more valid entries has a greater chance of winning than a user with fewer valid entries. The actual odds of winning depend on the total number of valid entries received.

  3. 5.3

    Unless the Draw Details state a maximum, a user may exchange as many available eligible points as they wish before the Draw closes.

  4. 5.4

    Entry is complete only when Housing Perks confirms that the points have been exchanged and the entries have been recorded. Users should check the confirmation shown in their account.

  5. 5.5

    Once points have been exchanged for entries, the exchange is final. The points are spent immediately, are no longer held by the user and will not be returned, including where the user does not win, misses the claim deadline, closes their account or ceases to be linked to a Housing Provider. This does not affect any remedy required by law or the correction of points deducted solely because of a verified technical error for which no valid entry was recorded.

  6. 5.6

    Entries cannot be transferred, sold, traded or assigned. Entries generated by automated methods, multiple or false accounts, manipulation, fraud or a breach of these terms are invalid.

06 — Prize draw terms

Closing of the Draw and expiry of entries

  1. 6.1

    At the closing time, all valid entries recorded for the Draw will form the entry pool.

  2. 6.2

    Entries apply only to the Draw for which they were obtained. They do not roll over to any later draw.

  3. 6.3

    If a user does not win, all of their entries in that Draw expire when the Draw is completed. The points exchanged for those entries remain spent and will not be restored.

07 — Prize draw terms

Winner selection

  1. 7.1

    After the closing time, the winner will be selected at random from all valid entries. Each entry will be included separately, so a user may appear in the entry pool more than once.

  2. 7.2

    Selection will be made using a computer process that produces verifiably random results. If such a process is not used, the selection will take place by or under the supervision of an independent person.

  3. 7.3

    The Promoter will keep appropriate records showing that the selection was conducted fairly and randomly.

  4. 7.4

    If there is more than one prize, prizes will be allocated in the order stated in the Draw Details or, if no order is stated, in the order in which winning entries are drawn. Unless the Draw Details say otherwise, a person may win no more than one prize in the same Draw.

  5. 7.5

    The Promoter may draw and record reserve winners at the same time and in random order.

08 — Prize draw terms

Winner notification and claiming a prize

  1. 8.1

    The Promoter will notify a selected winner using the in-app notification and/or the email address, telephone number or other contact details registered to the winner’s Housing Perks account. The Draw Details will state when notification is expected.

  2. 8.2

    The Promoter will make reasonable efforts to alert the selected winner. Users are responsible for keeping their account and contact details accurate and for checking Housing Perks notifications and their email, including spam or junk folders.

  3. 8.3

    A selected winner must claim the prize by following the instructions in the notification within 30 days beginning on the date the Promoter first sends the winner notification. Claiming a prize will not involve a fee or premium-rate contact method.

  4. 8.4

    If the selected winner:

    (a) does not claim within that 30-day period;

    (b) cannot be contacted after reasonable efforts;

    (c) rejects the prize;

    (d) is ineligible; or

    (e) fails to provide reasonably requested verification,

    their right to the prize expires. Their entries and points will not be returned.

  5. 8.5

    The Promoter may then offer the prize to the next reserve winner, who will have 30 days from their first notification to claim. The Promoter may repeat this process using the recorded reserve order. If no reserve winner validly claims despite the Promoter’s reasonable efforts, the prize may remain unawarded where permitted by the CAP Code and applicable law.

Prizes

  1. 9.1

    The number and nature of prizes, their approximate value where relevant, and all material conditions or restrictions will be set out in the Draw Details.

  2. 9.2

    A prize is non-transferable and no cash alternative is available unless the Draw Details expressly say otherwise.

  3. 9.3

    If circumstances outside the Promoter’s reasonable control make an advertised prize unavailable, the Promoter may substitute a prize of equal or greater value. The Promoter will not substitute a cash alternative unless the Draw Details allow it or the winner agrees.

  4. 9.4

    The Promoter will arrange delivery or fulfilment without charging the winner. Unless the Draw Details state a later date, the Promoter will use reasonable efforts to provide the prize within 30 days after a valid claim and completion of any required eligibility checks.

  5. 9.5

    The winner is responsible for any costs or arrangements expressly identified in the Draw Details as not included in the prize. Any potential tax liability will be stated where relevant. Nothing hidden or not stated before entry will be imposed as a condition of receiving the prize.

10 — Prize draw terms

Fair administration

  1. 10.1

    The Promoter may verify entries and disqualify an entrant only on reasonable grounds, including ineligibility, fraud, tampering, use of multiple or false accounts, automated entry, or a material breach of these terms.

  2. 10.2

    The Promoter may correct an obvious administrative or technical error where doing so is fair and does not disadvantage entrants.

  3. 10.3

    The Promoter may suspend, cancel or amend a Draw only where circumstances outside its reasonable control make this unavoidable. It will take reasonable steps to minimise disappointment and ensure that entrants who have already participated are not unfairly disadvantaged. Where practicable, it will complete the Draw using valid entries already received.

  4. 10.4

    The Promoter’s decision on the administration of the Draw is final, subject to applicable law and any right to complain to the Advertising Standards Authority or another regulator. This clause does not prevent an entrant from enforcing their legal rights.

11 — Prize draw terms

Publicity and winner information

  1. 11.1

    To demonstrate that a valid award took place, the Promoter will either publish or make available on request information such as the surname and county or region of major prize winners and, where applicable, their winning entries.

  2. 11.2

    An entrant may object before the Draw closes, or ask that less information be published or made available, by contacting hello@yourhousingperks.com. The Promoter will consider the request and will not prejudice the winner’s privacy. The Promoter may still provide winner information and the winning entry to the Advertising Standards Authority if required.

  3. 11.3

    A winner is not required to participate in publicity. Any request for additional publicity will be optional and subject to the winner’s separate agreement.

12 — Prize draw terms

Liability and consumer rights

  1. 12.1

    Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

  2. 12.2

    Subject to clause 12.1, the Promoter is not responsible for loss caused by events outside its reasonable control, or for an entry that is late, lost, corrupted or not recorded because of a user’s device, connectivity or account error, except to the extent caused by the Promoter’s failure to exercise reasonable care and skill.

  3. 12.3

    Nothing in these terms affects an entrant’s statutory or other mandatory consumer rights.
