Terms and Conditions for Website and Mobile App Use

Introduction
These terms and conditions apply between you, the User of this Website (including any sub-domains, unless expressly excluded by their own terms and conditions), and Housing Perks and Rainly Ltd (Company number 14525292, Everdene House, Deansleigh Road, Bournemouth, England, BH7 7DU) the owner and operator of this Website. Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website. If you do not agree to be bound by these terms and conditions, you should stop using the Website immediately. In these terms and conditions, User or Users means any third party that accesses the Website and is not either (i) employed by Housing Perks and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to Housing Perks and accessing the Website in connection with the provision of such services. You must be at least 18 years of age to use this Website. By using the Website and agreeing to these terms and conditions, you represent and warrant that you are at least 18 years of age. Intellectual Property and Acceptable Use
1. All Content included on the Website, unless uploaded by Users, is the property of Housing Perks, our affiliates or other relevant third parties. In these terms and conditions, Content means any text, graphics, images, audio, video, software, data compilations, page layout, underlying code and software and any other form of information capable of being stored in a computer that appears on or forms part of this Website, including any such content uploaded by Users. By continuing to use the Website you acknowledge that such Content is protected by copyright, trademarks, database rights and other intellectual property rights. Nothing on this site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, logo or service mark displayed on the site without the owner’s prior written permission.

Useage
2. You may, for your own personal, non-commercial use only, do the following; retrieve, display and view the Content on a computer screen or print one copy.

8. Any online facilities, tools, services or information that Housing Perks makes available through the Website (the Service) is provided “as is” and on an “as available” basis. We give no warranty that the Service will be free of defects and/or faults. To the maximum extent permitted by the law, we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality. Housing Perks is under no obligation to update information on the Website.

9. Whilst Housing Perks uses reasonable endeavours to ensure that the Website is secure and free of errors, viruses and other malware, we give no warranty or guaranty in that regard and all Users take responsibility for their own security, that of their personal details and their computers.

10. Housing Perks accepts no liability for any disruption or non-availability of the Website.

11. Housing Perks reserves the right to alter, suspend or discontinue any part (or the whole of) the Website including, but not limited to, any products and/or services available. These terms and conditions shall continue to apply to any modified version of the Website unless it is expressly stated otherwise.

Limitation of liability
12. Nothing in these terms and conditions will: (a) limit or exclude our or your liability for death or personal injury resulting from our or your negligence, as applicable; (b) limit or exclude our or your liability for fraud or fraudulent misrepresentation; or (c) limit or exclude any of our or your liabilities in any way that is not permitted under applicable law.

13. We will not be liable to you in respect of any losses arising out of events beyond our reasonable control.

14. To the maximum extent permitted by law, Housing Perks accepts no liability for any of the following: a. any business losses, such as loss of profits, income, revenue, anticipated savings, business, contracts, goodwill or commercial opportunities; b. loss or corruption of any data, database or software; c. any special, indirect or consequential loss or damage.

General
15. You may not transfer any of your rights under these terms and conditions to any other person. We may transfer our rights under these terms and conditions where we reasonably believe your rights will not be affected.

16. These terms and conditions may be varied by us from time to time. Such revised terms will apply to the Website from the date of publication. Users should check the terms and conditions regularly to ensure familiarity with the then current version.

17. These terms and conditions contain the whole agreement between the parties relating to its subject matter and supersede all prior discussions, arrangements or agreements that might have taken place in relation to the terms and conditions.

18. The Contracts (Rights of Third Parties) Act 1999 shall not apply to these terms and conditions and no third party will have any right to enforce or rely on any provision of these terms and conditions.

If any court or competent authority finds that any provision of these terms and conditions (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of these terms and conditions will not be affected.

20. Unless otherwise agreed, no delay, act or omission by a party in exercising any right or remedy will be deemed a waiver of that, or any other, right or remedy.

21. This Agreement shall be governed by and interpreted according to the law of England and Wales and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English and Welsh courts.

Use of Discounts and Cashback Service

Terms and Conditions for Use of Discounts and Cashback Service

Introduction
The following terms and conditions apply to the use of the Housing Perks App (the "App"), which is provided by Housing Perks which is operated by Rainly Ltd (Company number 14525292, Everdene House, Deansleigh Road, Bournemouth, England, BH7 7DU). By downloading and using the App, users agree to be bound by these terms and conditions. "User" is defined as anyone who is using the Housing Perks mobile app.

App Use
The App is intended for use by to receive discounts, cashback and free items from participating retailers. The App is free to download and we reserve the right to charge fees for any services offered through the App in the future. By using the app, users consent to Housing Perks offering services to them.

Discount
Discounts are set by participating retailers and regularly change. Housing Perks users should expect discounts and the products available to change. Housing Perks endeavours to maximise the availability of retailer but sometimes retailers will make vouchers unavailable. This is often the case if the retailer is upgrading their technical infrastructure and is typically temporary. Housing Perks cannot be held responsible for; retailers temporarily or permanently stopping voucher programmes, brands closing own or brands withdrawing their participating in the Housing Perks scheme.

Liability
Housing Perks is not responsible for the products or services provided by the retailers who are available through the app. Users must contact the brand directly to resolve anything that relaters to the brand's products or services. This includes but is not limited to any restrictions or changes to the terms of gift cards that retailers provide.

Limitations
The user is not permitted to share their login details to anyone. The user is not permitted to publish or share information about the discounts or brands available in the Housing Perks app or any other channel provided by Housing Perks. All sharing of information requires written approval by Housing Perks and it's parent company.

Security
Housing Perks is not liable for any loss or damage the user may suffer as a result of using the App, including but not limited to loss of data, loss of funds or loss of property. The user agrees to indemnify and hold Housing Perks harmless from any claims, losses, damages, or expenses (including legal fees) that arise from the user's use of any Housing Perks channel including the app, website or phone line or breach of these terms and conditions.

Personal Responsibility
It is the sole responsibility of Housing Perks users to keep their website, login details, identification or any other credentials secure and not open to use by anyone else. Housing Perks is not responsible or liable for any fraud that happens on the user's mobile phone or the Housing Perks app that is as a result of the user's action or non-action.

Termination
Housing Perks reserves the right to terminate the user's access to the App or any other Housing Perks channel at any time and for any reason. Upon termination, the user must immediately delete the App from their device.

Amendments
Housing Perks and parent company reserve the right to amend these terms and conditions at any time without notice. The user's continue use of the App after any amendments have been made will be deemed as acceptance of the updated terms and conditions.

Governing Law
These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms and conditions will be subject to the non-exclusive jurisdiction of the courts of England and Wales.

Returns Policy

My Gift Card Isn't Working

Online Shopping

  • Make sure you're entering it into the correct part of the website. If you're not sure where, try Googling how to pay with a gift card for that brand. Read the relevant information.
  • Check the balance of the card. If the gift card shows a code and/or a barcode and isn't used it is valid. To double check this, Google the brand and "check gift card balance". You'll find a website where you can check the balance of the card. Make sure the URL contains the brand, don't enter the gift card details into any random website. If the card has balance it does work. Try entering the details again.
  • Call the customer service line of the retailer. Generally, they are able to check whether gift cards are working.

Shopping In Store

  • If the barcode isn't scanning, make sure the screen on your phone is set to full brightness and the screen isn't damaged. If the gift card still doesn't work, ask the cashier to enter in the long number and pin (if applicable) manually. Make sure the cashier does enter the number correctly.
  • If entering the code isn’t an option we recommend printing out the gift card and taking it to the store.
  • Sometimes cashiers haven’t been trained on the difference between a voucher code and a gift card code. Ensure they have selected gift card code at the till.
  • On rare occasions, the brand’s gift card system may not be functioning. The cashier may not have been told about this. Call the customer service line of the retailer to ensure this isn’t the case.
  • Check the balance of the card. If the gift card shows a code and/or a barcode and isn't used it is valid. To double check this, Google the brand and "check gift card balance". You'll find a website where you can check the balance of the card. Make sure the URL contains the brand, don't enter the gift card details into any random website. If the card has balance it does work.
  • Make sure to write down at what store you tried to use the gift card and at what time.
  • Call the customer service line of the retailer. Generally, they are able to check whether gift cards are working.

Faulty Gift Cards

If you believe your gift card is faulty and have a specific purchase in mind do not buy the purchase anyway. Do not assume a refund or re-issue will be available even if it appears to be faulty. Follow the steps above first. For example, if the gift card number is entered into the wrong part of a retailers website it may appear faulty but it is not.

In some cases, the retailer’s system may take time to activate your gift card. In this case, it can take up to 48 hours for the gift card to be useable. In the event of this, contact the retailer directly as they may be able to speed this up or re-issue the gift card.

If you believe a gift card is faulty contact Housing Perks support with; a screenshot of any errors, details of when the gift card didn't work and as much evidence as possible within 1 day of purchase.

A re-issue of faulty or damaged Gift Cards is not available unless the fault or damage to the Gift Card is proven to be a result of the production or issuing process or otherwise due to the fault of us or our agents or contractors or where otherwise required by law. If you want a return or refund contact us with a screenshot of any errors, reason for your request and proof of purchase. If any value on a Gift Card has been spent we are unable to process a return or refund unless required to by law. We’re not responsible for the refund of purchase price or return of any products purchased from Retailers.

Housing Perks has the right to refuse a refund or re-issue if the process hasn’t been follower and/or evidence hasn’t been provided. Housing Perks may ask you to identify yourself if we believe there has been fraudulent activity.

If You’ve Changed Your Mind or Made An Accidental Purchase

If you’ve purchased a gift card and changed your mind make sure not to open it. Don’t tap the “View” button on the gift card in your wallet. If you tap “View”, the gift card will be logged as used and cannot be cancelled.

If you’ve made an accidental purchase let us know which gift card was accidentally purchased within 24 hours and we can apply for a cancellation from the retailer.  In most cases, the retailer will accept this cancellation if the gift card hasn't been viewed.

If the gift card has been viewed, please contact the retailer directly as they have the ability to offer a refund or re-issue.
